Myschedule Terms and Conditions

These Terms and Conditions ("Terms" or "Terms and Conditions") govern your use of this website, www.myschedule.pro (the "Site"), your use of the booking service offered through the Site ("Service") and your relationship with Myschedule ("we", "us" or "myschedule.pro"). Please read these Terms carefully as they affect your rights and liabilities under the law.

If you do not agree to these Terms and Conditions, please do not use the Service or the Site, or register as a member.

  1. Introduction

    1. This Site provides access to an online scheduling and booking system...
    2. These Terms will apply to subscribers, registered members and to those who simply view the Site ("you").
    3. By using the Site and the Service, you agree to be bound by these Terms and Conditions in full.
    4. You are responsible for ensuring that all persons who access the Site through your internet connection comply with these Terms.
    5. If you are accepting these Terms on behalf of a business, you agree that they apply to all personnel using the Service under your organization.
    6. These Terms may be amended from time to time. Continued use implies acceptance of any changes unless you cancel within 30 days.
  2. Registration

    1. You can view the Site or make bookings without registration.
    2. To use the Service for scheduling, you must register and create an account.
    3. Personal information provided during registration will be handled per ourPrivacy and Data Protection Notice.
    4. Passwords must be kept confidential. Notify us at sales@sunsoftny.com if you suspect misuse.
    5. Third-party login integrations (e.g. Google) are supported but must be kept secure.
    6. We may suspend your account in the event of suspected breach or misuse.
    7. All information provided must be accurate and up to date.
    8. You may have multiple memberships, but impersonation or false info is not permitted.
    9. Membership can be canceled at our discretion.
  3. Subscription

    1. Some features are limited to subscribed members.
    2. You choose a subscription plan and term when subscribing.
    3. We may change plan features or duration but you'll retain your current plan until it ends.
    4. Plan downgrades result in credit held in your account; refunds are not issued for unused amounts.
    5. Legacy pricing may apply until cancellation or account lapse.
    6. We may offer trial periods; access ends if you don’t subscribe afterward.
    7. Credit card is preferred for payment; other methods may be allowed for enterprise deals.
    8. Non-payment or chargebacks may result in immediate suspension of access.
  4. Account Restrictions

    1. You may not resell or sublicense the Service to third parties.
    2. Each subscription is limited to a single legal entity in one country.
    3. You may not process bookings for multiple organizations under one account.
    4. If acting for clients, each must have a separate account and you must be authorized to act for them.
    5. Admin tools for client/staff management may be provided at our discretion.
    6. These restrictions apply to all plans.
    7. Linked accounts under a master plan must share the same email domain unless agreed otherwise.
    8. You're responsible for usage and compliance by users under your account or linked accounts.

Scheduling and Bookings

  1. The Service operates by linking with a third party calendar account (e.g. Google Calendar) and communicating with you by email...
  2. To allow bookings, you must share your booking grid via URL or embed with your Customer.
  3. The Service fetches availability from your calendar and displays it in real-time for booking.
  4. You may auto-confirm or manually approve bookings and send confirmation or reminder emails.
  5. Emails are sent via third-party provider for deliverability, though delivery isn't guaranteed.
  6. Enhanced options may include intake forms, advance payments, or additional data capture.
  7. SMS Credits can be purchased separately for reminders; credits have no cash value and are not refundable.
  8. The system is automated. Availability accuracy depends on the connected calendar; we do not verify the information.

Acceptable Use Policy

  1. Use of the Service must be for legitimate, ethical business or social purposes. Accounts may be removed without notice if misused.
  2. You're granted limited personal access; do not copy or modify the Site or its software without permission.
  3. Do not share defamatory or malicious content regarding the platform or its services.
  4. You must not:
    1. Solicit access to accounts that aren’t yours.
    2. Harass or bully users.
    3. Use the platform for illegal, misleading, or harmful activity.
    4. Promote offensive or damaging business activities via the platform.
    5. Imply endorsement by Myschedule without consent.
    6. Impersonate anyone else.

Content

  1. Users can create and distribute custom content (e.g. booking forms, email messages) through the Service.
  2. You must own or be authorized to use any Content you distribute; you are liable for any violations.
  3. You bear full responsibility for any legal claims resulting from your Content.
  4. Myschedule is not liable for user-generated Content; you agree to indemnify us for claims.
  5. Do not post offensive, false, defamatory, or illegal content.
  6. Specifically, your Content must not:
    1. Promote racism, hate, or harm to individuals or groups.
    2. Harass or advocate harassment of others.
    3. Display or promote sexually explicit material.
    4. Include defamatory, threatening, or obscene messages.
    5. Violate copyright, privacy, or confidentiality laws.
    6. Share pirated software, music, or bypass protections.
    7. Provide illegal activity instructions (e.g. hacking).
    8. Solicit sensitive data from others for unlawful purposes.
    9. Engage in spam, chain letters, or bulk messaging.
    10. Spread false or misleading information.
    11. Include personal information without consent.
    12. Run unauthorized promotions, contests, or ads.
    13. Accept payments not related to genuine bookings.
    14. Promote multi-level marketing or pyramid schemes.
    15. Promote crypto/ICO offerings or investments involving loss risk.
  7. By submitting Content, you grant us permission to use it to operate the Service. We may remove it at any time.

Collection of Prohibited Data

  1. The Service must not be used to store sensitive, financial, or medical data about others without their explicit consent. This includes data defined as 'special category' under GDPR.
  2. If such use is discovered, we may immediately remove the data and delete your account without notice.

Viruses, Hacking and Other Offences

  1. Do not upload or distribute files containing malicious code.
  2. Unauthorized access attempts, denial-of-service attacks, or introducing harmful material are prohibited and may be criminal offences under the Computer Misuse Act 1990.
  3. We will report any such breach and cooperate with authorities, terminating access immediately.
  4. We are not liable for damage caused by malware or attacks.

Availability

  1. We aim for high availability but do not guarantee uninterrupted access. Report issues to sales@sunsoftny.com.
  2. Third-party limits or high usage may restrict access temporarily and do not constitute breach.
  3. Access may be disrupted due to maintenance or events beyond our control, without breaching this agreement.

Our Liability

  1. We operate with reasonable skill and care but do not monitor all content or usage in detail.
  2. Our liability is limited as allowed by law.
  3. We are not liable for unavailability (as per Availability clause).
  4. We do not guarantee service usage, performance, or content accuracy; violations may result in removal or termination.
  5. We are not responsible for indirect loss, loss of profit, or data corruption.
  6. Free users are not entitled to liability claims; subscribers are limited to one month's subscription value.
  7. This does not limit liability for fraud or personal injury caused by negligence.
  8. You agree to resolve disputes with other users independently and release us from related claims.

Cancellation and Termination

  1. To cancel:
    1. Use the billing page → ‘Cancel subscription’
    2. Email sales@sunsoftny.com
  2. You will keep access to paid features until the end of your billing cycle, unless you request immediate removal. No refunds for unused time.
  3. Accounts funded through organizations may be suspended if the sponsor defaults.
  4. To delete your account:
    1. Use settings → ‘Delete account’
    2. Or email sales@sunsoftny.com
  5. Account deletion is permanent and unrecoverable.
  6. The following actions are NOT cancellations:
    1. Removing profiles
    2. Setting profile end dates
    3. Unlinking calendars
    4. Deauthorizing integrations
    5. Inactivity
  7. We may terminate accounts without notice for violations.
  8. Suspensions may occur during investigations; termination may follow if issues are confirmed.
  9. Full refunds only apply if cancellation occurs within 30 days of subscription start.
  10. No refunds after 30 days from initial subscription date.
  11. SMS credit fees are always non-refundable.
  12. Exceptional refunds may occur with a fee of $20 or 1 month’s subscription — whichever is greater.
  13. If your subscription lapses for 12 months, we may delete your account and credit.
  14. Unused SMS credits may expire after 6 months of inactivity.

Data Protection

  1. Terms like "Controller" and "Processor" follow the definitions under GDPR.
  2. You must ensure that all submitted personal data is accurate and complete.
  3. We control and store login/contact data as outlined in our Privacy and Data Protection Notice.
  4. You are the Controller for data like calendar info; we act as your Processor. Calendars like Google have their own policies.
  5. Our processing is governed by a standard DPA. View theDPA here.
  6. If needed, contact us for a signed DPA at sales@sunsoftny.com.

Notice, Take-Down and Suspension

  1. We attempt to remove accounts and content in violation, but require sufficient evidence.
  2. To report abuse, contact us via email or mail including:
    1. Your contact details
    2. URL of offending content
    3. Description of the content
    4. Reason for concern
    5. Authorization proof
    6. Signed declaration
  3. Notices may be used in court.

International Use

  1. You must comply with your country’s laws including consumer and export laws.

General

  1. These Terms are governed by the laws of England and Wales.
  2. We retain the right to enforce Terms at any time even if initially we don't.
  3. We are not liable for issues caused by events beyond our control.
  4. We may change the format, content, or features of the Site without notice.
